9th Annual State of Nonprofits and Philanthropy Summit Series

This Summit features findings from the 2021 State of Nonprofits and Philanthropy Report which highlights the current state of San Diego’s nonprofit sector and the philanthropy that supports it. The report features input and insight from over 200 nonprofit leaders as well as the results of ongoing public opinion polling, and analysis of nonprofit employment and economic data.

2021 Outstanding Nonprofit Lawyer Award Recipient – Mary T. Dowling, Esq.

The legal nonprofit community has named the 2021 recipients of the annual “Outstanding Nonprofit Lawyer Awards.” The Nonprofit Organizations Committee of the American Bar Association, Business Law Section, recognizes accomplished and civic-minded nonprofit lawyers in the categories of Academic, Attorney, In-House Counsel, and Young Attorney. Additionally, the Committee bestows the Vanguard Award on a leading legal practitioner for his or her lifetime commitment to the nonprofit field.

“Do It Right From the Get Go – Legal Compliance Considerations” (January 14, 2017 / January 24, 2019)

Workshop leader and speaker at annual Nonprofit Governance Symposium at the University of San Diego. This workshop outlined annual compliance requirements for nonprofit organizations as to IRS, Franchise Tax Board, and Attorney General filings. The workshop was intended to provide guidance to help nonprofit entrepreneurs ensure proper maintenance of tax-exempt status by providing an overview on how to reduce overall legal risks and liabilities commonly faced by nonprofit organizations. This workshop also discussed employment issues surrounding staff, volunteers and independent contractors, the necessity of internal policies and insurance coverage, common provisions that should be included in every contract, as well as, licensing and permitting requirements.

“Increasing Your Nonprofit’s Revenue and Overall Social Impact” (January 14, 2018):

Workshop leader and speaker at annual Nonprofit Governance Symposium. This workshop explored several possible mechanisms and vehicles for cause-related collaborations between nonprofit and for-profit entities that result in increasing both organizational revenue and overall social impact. We will review successful case studies, and will also explore the appropriate structuring of such ventures between a non-profit and for-profit business including: collaborations, strategic alliances, formal joint ventures, commercial co-ventures, and how to turn corporate charitable giving into a co-marketing opportunity. This session will also highlight the importance of understanding the legal hurdles associated with such ventures, and the methods necessary to protect the nonprofit’s exempt status.

“How to Structure Joint Ventures with For-Profit Entities” (January 15, 2018)

Workshop leader and speaker at annual Nonprofit Governance Symposium at the University of San Diego. This workshop dives into a technical discussion of legal and tax considerations surrounding joint ventures between exempt organizations and for-profit entities.

Ancillary Exemptions and Compliance Considerations” (January 13, 2017)

Workshop leader and speaker at annual Nonprofit Governance Symposium at the University of San Diego. This presentation examined the welfare exemption requirements and application process as well as the imposition of sales and use tax on nonprofit organizations in California. The welfare exemption process can be a trap for the unwary as many nonprofits that were able to obtain exemption under 501(c)(3) find they do not meet the strict requirements set forth by the Board of Equalization.
